Reincubate Accuses Apple of Stealing Camo Tech and Blocking App

Apple faces a new legal challenge from Reincubate, the London company behind the Camo webcam app. The complaint in New Jersey federal court alleges patent infringement and antitrust violations over Apple’s Continuity Camera feature that debuted in 2022.

Patent and Antitrust

Reincubate says two of its US patents cover the core idea. The patents are listed in the suit as US Patent No. 11,924,258 and US Patent No. 12,335,323. The complaint says those patents describe a system that links a capture device to a control device through a cooperating application and splits video processing tasks between them. Reincubate argues that Continuity Camera practices the same concepts that its patents protect.

The suit also raises antitrust and monopoly claims. Reincubate says Apple encouraged the company during Camo’s beta period and that Apple then used its platform control to replicate the functionality and limit Camo’s reach. The complaint asserts that system-level features in Apple software can block or degrade third-party apps and that Continuity Camera has the effect of sidelining competitors. Reincubate seeks damages and legal orders to stop what it calls exclusionary conduct.

The company says it showed the product to Apple staff and that thousands of Apple employees used Camo internally. Reincubate founder Aidan Fitzpatrick says Apple praised the app and discussed collaboration while Reincubate invested further in development. The lawsuit describes a shift from encouragement to exclusion after Apple demonstrated a similar feature on stage at WWDC 2022. Reincubate claims that the Continuity Camera, at times, launches automatically and interferes with Camo on devices in ways that the developer cannot work around.

Apple has not formally responded in court as of this date, and the firm refused to comment in the press releases that followed the filing. Legal experts observe that the same cases concerning the functionality of platforms and the rival applications have been disputed in court, and plaintiffs have won and lost these cases.

What the Lawsuit Asks

Reincubate requests the court to find that the patent is infringed and deal with the supposed anticompetitive behavior. The complaint seeks financial reparation and injunctive damages, which may also involve revisions of the way Apple enables third-party camera software to run on its platform.

Courts will examine patent claims for novelty and scope. Critiques of the allegations by the antitrust judges will also be under scrutiny to the control of platforms and damage to consumers. The case is placed in the context of more general regulatory and legal attention to major platforms. The court will determine the schedule of motions and a trial date once Apple has made a response.
